Statement of Claim

1. On 26 September 2007, Samuel, David, Hiu Yeung, and Kevin went to Tuen Mun.

2. It was agreed by all parties to meet at 4pm at the Diamond Go Kart Place in Tuen Mun (the "Go Kart Place")

3. In particular, by a telephone conversastion dated 26 September 2007 at around 12pm, Kevin called Samuel to tell him that it will take 1.25 hours to get to the Go Kart Place from Mong Kok KCR statation (the "Instructions")

4. In reliance of the Instructions, Samuel planned his trip to the Go Kart Place.

5. Samuel eventually got to the Go Kart Place at around 5pm

6. Further, Samuel has suffered loss and damages from his trip to Go Kart Place

PARTICULARS OF LOSS AND DAMAGES

(a) taking a minibus to Hunghom KCR, then KCR to Mong Kok, then Bus at Mong Kok for 40 minutes, then wait for bus for 15 minutes then another 20 minute bus ride causing severe headahce and fatigue;

(b) David calling Samuel to run from Lung Kwoo tan to Go Kart Place consisting of running like a crazy boy until he nearly fainted for 10 minutes

7. As a result of severe exhaustion, Kevin, Hiu Yeung (hereinafter "DWM") and David tricked Samuel into believing that he should get out of a go kart by touching its oil tank and also memorizing the price for each component part of a Go Kart.

8. Due to Samuel's intelligence however, he never touched the oil tank.

AND THE PLAINTIFF CLAIMS:

(a) A Declaration that he had so much fun on that day driving a go kart that he nearly killed himself from either the sheer force from the speed of the kart or how he skidded off the track too many times

(b) A Declaration that Samuel was a skilled driver and his lap time was among the best

(c) An Order that this Statement of Claim be struck out as it makes no sense

(d) Costs

(e) Further and/or other relief as the Court sees fit as the Plaintiff is now broke.
